Please read these Terms and Conditions carefully before engaging the services of STRA Evacuation Plans Pty Ltd. By placing an order or using our website, you agree to be bound by these terms.
1. About Us
STRA Evacuation Plans Pty Ltd (ABN 57 654 044 247) ("we", "us", "our") provides evacuation diagram preparation and emergency information pack services for short-term rental accommodation (STRA) properties in New South Wales, Australia.
2. Services
We prepare compliant evacuation diagrams and emergency information packs for STRA properties as required under the NSW Short-term Rental Accommodation Code of Conduct and relevant fire safety standards.
Our services are provided based on the floor plans and information you supply to us. The accuracy and completeness of the final diagrams depends on the accuracy of the materials you provide.
3. Orders and Payment
An order is accepted when we confirm it in writing (including by email). Payment terms will be communicated at the time of quoting. We reserve the right to withhold delivery of completed diagrams until payment has been received in full.
Prices quoted are in Australian dollars (AUD) and include GST unless otherwise stated.
4. Your Responsibilities
You are responsible for:
- Providing accurate and up-to-date floor plans and property information.
- Ensuring the completed diagrams are displayed at the property as required by applicable laws and the NSW STRA Code of Conduct.
- Notifying us promptly of any changes to the property that may affect the accuracy of the diagrams.
- Obtaining any necessary consents or approvals from property owners, strata managers, or other relevant parties before engaging our services.
5. Turnaround and Delivery
We will use reasonable endeavours to deliver completed diagrams within the timeframe agreed at the time of order. Turnaround times are estimates only and may be affected by the volume of orders, the complexity of your property, or delays in receiving required information from you.
Completed diagrams will be delivered electronically in PDF format to the email address you provide.
6. Revisions
We will make reasonable revisions to completed diagrams where errors arise from our work. Revisions requested due to inaccurate or incomplete information supplied by you may be subject to an additional charge.
7. Intellectual Property
Upon receipt of full payment, you are granted a non-exclusive licence to use the completed diagrams for the property for which they were prepared. We retain all intellectual property rights in our templates, methodologies, and design elements.
You must not reproduce, resell, or distribute our diagrams for use at other properties without our prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with our services is limited to the amount paid by you for the specific service giving rise to the claim.
We are not liable for any indirect, consequential, special, or incidental loss or damage, including loss of revenue, loss of profit, or loss of data, arising from your use of our services or diagrams.
Nothing in these terms limits or excludes any guarantee, warranty, right, or remedy that cannot be excluded under the Australian Consumer Law.
9. Compliance Responsibility
While we prepare diagrams in accordance with applicable NSW STRA requirements and fire safety standards at the time of preparation, it is your responsibility to ensure ongoing compliance with all applicable laws, codes, and regulations. We recommend reviewing your diagrams whenever the property layout changes or relevant regulations are updated.
10. Cancellations and Refunds
If you wish to cancel an order, please notify us as soon as possible. Where work has already commenced, a cancellation fee may apply to cover work completed to that point. Refunds will be assessed on a case-by-case basis in accordance with the Australian Consumer Law.
11. Privacy
We handle your personal information in accordance with our Privacy Policy, available on our website. By engaging our services, you consent to the collection and use of your information as described in that policy.
12. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. The current version will always be available on our website. Continued use of our services after any changes constitutes your acceptance of the updated terms.
